This Privacy Policy describes how Pilates Collective, including services doing business as Wellness by Pilates Collective (referred to as “we,” “us,” or “our”), collects, uses, and shares information about you through our website, mobile application, in-studio interactions, and any other means by which you interact with us.

 

1. INFORMATION WE COLLECT

We collect information about you when you visit our Site, including:

  • Personal Information: We collect personal information you provide to us, such as your name, email address, phone number, and payment card information. We also collect sensitive personal information, including health screening data (PAR-Q forms), liability waivers, emergency contact details, body measurements or physical condition information for class customization, and potentially CCTV/camera footage if applicable. This information is collected when you purchase class packages, register for classes, subscribe to our newsletter, or interact with us.   • Analytics and Cookies and Do Not Sell/Share: We use tracking technologies, including cookies (such as strictly necessary, functional, analytics, and advertising cookies), Google Analytics, and Meta Pixel (Facebook Pixel), to understand how visitors interact with our Site, analyze traffic, and support advertising. Our use of Meta Pixel constitutes "sharing" of personal information for cross-context behavioral advertising under the CPRA. You can manage your cookie preferences through a consent banner and opt out of this sharing, including by enabling the Global Privacy Control (GPC) browser signal, which we honor. For complete details on your opt-out rights, please refer to Section 9.

 

2. USE OF YOUR INFORMATION

We may use the information we collect about you for various purposes, including to:

  • Provide, maintain, and improve our services;

  • Communicate with you, including sending you newsletters and promotions;

  • Understand and analyze how you use our services and Site to develop new products, services, features, and functionality.

 

In addition, we use the order information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to communicate with you.

 

3. SHARING YOUR INFORMATION

We do not share your personal information with third parties except as described in this Privacy Policy, such as:

  • With service providers and processors performing services on our behalf, who are contractually bound by a CPRA-compliant Data Processing Agreement (DPA) or Service Provider Agreement. These categories of third parties include: our class scheduling platform (Arketa), our payment processor (Stripe), analytics and advertising providers (Google and Meta), and our email marketing platform.

  • If required to do so by law or in response to a subpoena or court order;

  • In connection with a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets. In such an event, we will commit to notifying users before their personal information is transferred to a new entity that has materially different privacy practices.

 

4. YOUR CHOICES AND RIGHTS

5. DATA SECURITY

We implement reasonable security measures designed to protect the security of any personal information we process, including encryption of data in transit and at rest, administrative access controls, and regular security assessments. In the event of a data breach affecting your personal information, we will notify you as required by applicable California law, including California Civil Code §1798.82. However, please note that no system is completely secure, and we cannot guarantee the security of our database, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the Internet.

 

6. CHANGES TO THIS PRIVACY POLICY

For material changes, we will notify you by email or prominent Site notice at least 30 days before the changes take effect. Your continued use of the Site after such notice constitutes acceptance of the updated Privacy Policy.

8. CATEGORIES OF PERSONAL INFORMATION COLLECTED 

In the past 12 months, we have collected the following categories of personal information: (1) Identifiers, such as name, email address, phone number, and account credentials; (2) Customer records, including payment card information and purchase history; (3) Health and medical information, including PAR-Q screening responses, medical contraindications disclosed on intake forms, and emergency contact information (this constitutes Sensitive Personal Information under CPRA); (4) Internet or electronic network activity, including browsing behavior on our Site collected via cookies, Google Analytics, and Meta Pixel; (5) Geolocation data, to the extent inferred from IP address or booking location. We collect this information directly from you, automatically through your use of the Site, and through third-party service providers including Arketa (scheduling), our payment processor, Google, and Meta.

 

9. DO NOT SELL OR SHARE MY PERSONAL INFORMATION

Under the California Privacy Rights Act (CPRA), California residents have the right to opt out of the sale or sharing of their personal information. We use Google Analytics and Meta Pixel on our Site. Under CPRA, sharing personal information with these platforms for cross-context behavioral advertising may constitute a “sale” or “sharing” of personal information, even without monetary exchange. You may opt out of this sharing by: (1) Using the Global Privacy Control (GPC) browser signal, which we honor; or (2) Contacting us at hello@pilatescollective.org. We do not sell your personal information to third parties for monetary consideration.

 

10. SENSITIVE PERSONAL INFORMATION

We collect health and medical information through our PAR-Q screening forms and Liability Waivers, which constitutes Sensitive Personal Information (SPI) under CPRA. We use this SPI solely for the purposes of: (a) determining your eligibility to safely participate in our Remediation Services; (b) facilitating emergency medical care if required; and (c) complying with our legal obligations. We do not use or disclose your health information for purposes beyond those for which it was collected without your explicit consent. You have the right to limit our use of your Sensitive Personal Information to these necessary purposes by contacting us at hello@pilatescollective.org.

 

11. DATA RETENTION

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting obligations. Specifically: account and purchase records are retained for a minimum of 7 years for tax and accounting purposes; health screening data (PAR-Q forms, Liability Waivers) are retained for a minimum of 7 years; marketing preferences are retained until you opt out. When personal information is no longer needed, we will securely delete or anonymize it. 

 

12. CALIFORNIA PRIVACY RIGHTS — HOW TO EXERCISE 

California residents may exercise the following rights by submitting a verifiable consumer request to hello@pilatescollective.org or by calling 858-367-9070: (1) Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you, the sources, the business purposes, and the categories of third parties with whom we share it; (2) Right to Delete: Request deletion of your personal information, subject to certain exceptions; (3) Right to Correct: Request correction of inaccurate personal information; (4) Right to Opt-Out of Sale/Sharing: As described in Section 9; (5) Right to Limit Use of Sensitive Personal Information: As described in Section 10; (6) Right to Data Portability: Receive a copy of your personal information in a portable format; (7) Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights. We will respond to verifiable requests within 45 days, with a possible 45-day extension for complex requests. Authorized agents may submit requests on your behalf with written permission.

 

13. CHILDREN’S PRIVACY 

Our Site and Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. Recovery Services are restricted to individuals 18 years of age or older. If we become aware that we have inadvertently collected personal information from a child under 13 without parental consent, we will take steps to delete that information as soon as possible.
